TO THE FULLEST EXTENT PERMITTED BY LAW, CABOT MEDICAL, PLLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
CABOT MEDICAL’S TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the limitation or exclusion of liability, so some of these limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Cabot Medical, PLLC and its officers, directors, employees, agents, and licensors from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
